HAWAII’S HOUSE OF GOLD (HHG)
RULES AND PROCEDURES
Hawaii’s
House of Gold (HHG) is a direct sales company that markets its products
and services through Independent Distributors. The following Rules and
Procedures are what a HHG Independent Distributor agrees to once he/she
has filled out and signed a Distributor Agreement Form. All potential
distributors should be made familiar with these Rules and Procedures
before signing the Distributor Agreement Form.
HHG Distributorship
There is no fee to become a HHG Distributor. There is no annual renewal fee.
2. To qualify for HHG Distributorship the individual must not be a
minor, must have a valid address in the United States or US
Territories, have a valid Social Security Number or Federal Tax ID
number if the individual is a business entity such as a partnership,
LLC, Corporation or Trust.
3. A qualified individual is considered a distributor once a completed
and signed HHG Distributor Agreement Form is received by the HHG Home
Office. The form must have the sponsor’s HHG ID number to be valid.
4. Once HHG has received a valid Distributor Agreement form it will
mail the new distributor his/her HHG ID number. This ID number is to be
used with all transactions/correspondence between the distributor and
HHG.
5. If a distributor wishes to start business immediately, signing up
via fax, online or through the mail, they may call HHG during business
hours and receive an ID number that will be good indefinitely once a
hard copy of the signed Distributor Agreement Form is received. If the
hard copy is not received within 30 days, the ID number will be
canceled.
6. A Distributor Kit will come with the new distributor’s first order.
7. Distributors will receive free HHG Newsletters with products shipments.
8. If for 12 months in succession no purchase of products has been made
by a HHG Distributor, Hawaii’s House of Gold will take this to mean
that the individual is no longer interested in being a HHG Distributor,
and the distributorship will be automatically canceled.
9. HHG can not guarantee the success of any individual distributor.
10. Before the 22nd of every month, HHG Distributors will have their
Activity Status Report, which will reflect their previous month
activity with HHG, mailed to them. The Activity Status Report will not
be mailed out to distributors with 2 or more months of inactivity.
11. The HHG Distributor Agreement Form cannot be altered or changed in
any way. This agreement is legally binding once signed.
12. A HHG Distributor may cancel his/her distributorship any time
without reason, by sending a notice of distributorship cancellation in
writing to HHG Home Office. The notice must include the HHG ID number
and be signed.
13. A HHG Distributor is not allowed to sponsor someone who is his/her
sponsor.
HHG Business Guidelines
1.
The HHG Distributor takes full responsibility for any claims made
regarding the products and marketing plan of Hawaii’s House of Gold
(HHG), if those claims come from sources other than materials approved
by HHG.
2. Any advertisement, flyer, tape or other form of
information using the HHG name or logo must be sent to the Home Office
for approval before use. Copies of HHG literature may be made, without
permission as long as copies are intact with no change. Audio and video
tapes may not be copied without permission. Ads may be placed without
permission if they do not include the HHG name or logo.
3. Distributors may sell their distributorship to another party with
written permission from HHG. Allow two weeks for the transaction to be
studied and approved. The party selling the distributorship will be
charged a $50.00 handling fee.
4. The HHG Distributor’s name and HHG ID number must always appear on all Purchase Order Forms and correspondence with HHG.
5. HHG Distributors are free to participate in other direct sales or
network marketing business opportunities without concern of losing
their distributorship. However, a HHG Distributor may not recruit other
HHG Distributors, except those they personally have sponsored, for any
other direct sales or network marketing businesses. Such behavior by a
HHG Distributor could result in a cancellation of his/her
distributorship!
6. HHG Distributors shall not offer the HHG opportunity through any
other system, or method of marketing other than that of HHG, without
written permission from HHG. The HHG Distributor shall not require or
encourage prospective distributors to make any purchase from, or
payment to, any other entity to participate in the HHG compensation
Plan. Such behavior by a HHG Distributor could result in a cancellation
of his/her distributorship!
7. HHG Distributors must limit the resale of HHG products and the
presentation of the HHG opportunity to those located within the United
States and US Territories.
8. The HHG Distributor may not state that profits are guaranteed for
any HHG Distributor. The HHG Distributor should make it clear to
prospective distributors that profit is made by the sale of HHG
products and commissions from the sales organization, and that to
attain this goal requires effort on his/her part.
9. The HHG Distributor may not relabel or refill any of HHG’s products.
HHG products must be sold in their original containers.
10. There are no exclusive territories granted to anyone. HHG Distributors may sell HHG products at any price they choose.
11. HHG may cancel a distributorship of a distributor who brings disrepute upon HHG.
12. HHG Distributors may not solicit people through email spamming methods.
13. HHG reserves the right to make changes in pricing of its products,
its policies and procedures and to its marketing plan, in order to
comply with laws and maintain a market advantage.
14. HHG will consider that 70% of all product purchased by the distributor will be for resale and 30% for personal use.
15. HHG reserves the right to discipline any HHG Distributor who
violates the policies and procedures of HHG, found in the HHG Company
Manual. A disciplinary action can take the following forms:
A. Withhold Commission Checks.
B. Lose rights to one or more bonus and commission checks.
C. Cancellation of Distributorship
D. In certain situations deemed appropriate by HHG, the company may
institute legal proceeding for monetary relief. Before any such action
would be taken, HHG would send written notice by certified mail,
warning the distributor of the violation, requiring him/her to take
corrective action.
16. If any HHG Distributor has a dispute, grievance or complaint with
another HHG Distributor regarding conduct pertaining to their
respective HHG businesses, the complaining distributor should first
make known the problem to his/her sponsor who should review the matter
and try to resolve it. If the matter cannot be resolved, it must be
reported in writing to HHG. The company will attempt to resolve it
after reviewing the facts.
17. The HHG Distributor is an independent contractor and not an
employee. His/her success depends on independent efforts. The agreement
between HHG and its distributors does not create an employer/employee
relationship, agency, partnership or joint venture between the company
and the distributor. The HHG Distributor is responsible for paying
local, state and federal taxes due from all compensation earned as a
distributor of the company.
18. No individual may receive compensation from more than one HHG
business. Married couples regardless of whether one or both are
signatories to the Distributor Agreement, may not own or operate any
other HHG business, either individually or jointly, nor may they
participate directly or indirectly (as a shareholder, partner, LLC
member, trustee, trust beneficiary or any other legal or equitable
ownership) in the ownership or management of another HHG business in
any form.
19. Under no circumstances will HHG split commission and bonus checks
between divorcing spouses or members of dissolving entities. Commission
checks shall always be issued to the same individual or entity. In the
event that parties to a divorce or dissolution proceeding are unable to
resolve a dispute over the disposition of commissions and ownership of
the business, the distributorship may be canceled.
20. If a distributor believes any errors have been made regarding
commission, bonuses, business reports or charges, the distributor must
notify HHG in writing within 30 days of the date of the purported error
or incident in question. HHG will not be responsible for any errors,
omissions or problems not reported within 30 days.
21. HHG will not be responsible for delays or failures in its
performance of its obligations when performance is made impracticable
due to circumstance beyond its reasonable control, such as war,
strikes, riots, fire, earthquake and other natural disasters,
curtailment of a party’s source of supply, or government decrees or
orders.
Ordering Policies
1. HHG accepts orders by mail, fax, phone or internet.
2. Distributors may pay for the orders by credit card (Visa,
MasterCard, American Express, and Discover), debit card, by check that
can be faxed or mailed in, or by money order, which must be mailed in.
Check and money orders are to be made out to Hawaii’s House of Gold.
3. All distributors must purchase directly from HHG.
4. No C.O.D. orders will be accepted.
5. Distributors may designate any month they wish an order to be
credited to. On the Purchase Order Form the month and year to which
they are to be credited to must be written in the appropriate section.
Otherwise the order will be credited to the month it is received.
6. Orders may be credited up to 12 months in advance. This will assure
that a distributor will not go inactive and lose seniority and the
distributors he/she sponsored.
7. A minimum order is 50 CP (Commissionable Points). In order to be
considered active and qualify for sales commissions the order must come
to at least 250 CP.
8. The HHG ID number must come with every order.
9. A distributor calling in an order should make sure he/she has the
order and credit card ready. Give the HHG ID number first, then the
Order Department operator will confirm the address the product is to be
shipped to. Next, the distributor will be asked to read off the item
number and quantity that he/she wishes to order. The product and
shipping cost will be totaled, and then the distributor will be asked
for credit card information. The distributor may be asked to wait to
see if the credit card clears.
10. Distributors are asked not to tie up the order line attempting to
create orders over the phone, ask questions about the marketing plan,
or other things not pertaining to the order. For questions the
distributor is asked to call Customer Service.
11. When mailing or faxing in an order the Purchase Order Form should
be used. The HHG ID number must be used with each order in order to
process it.
12. Distributors should take care not to fax in an order and then call
it in also, or they will find that they have placed two orders and will
receive two orders in the mail. If a distributor calls after faxing in
an order, it should only be to confirm that the fax was received.
13. All orders will be shipped (distributors are charged for shipping)
directly to your home or PO address within 48 hours of being received,
unless an item is back ordered. HHG will send out the back ordered item
as soon as it has received additional inventory.
14. Full payment for orders must be received before products can be shipped.
15. All orders must be received by 5:00 PM Hawaii Standard Time on the
last working day of the month, if they are to be credited for that
month. Otherwise the orders will be credited for the month that it was
received. Orders should be mailed early in the month!
16. If a distributor is signed up for the Autoship Program, he/she will
be shipped the item on or before the 15th of each month. It is the
distributor’s responsibility to make sure funds are available from
their credit card or checking account. If there is not sufficient funds
to process the order, an attempt will be made to contact the
distributor to remedy the situation. If the attempts to contact the
distributor fails, then the distributor will go inactive for the month
and will lose seniority. Distributors may call Customer Service to find
out if they are active for the month or not.
17. In the case of a price change, those on Autoship will be
automatically charged the amount of the new price. New price changes
will be announced in the newsletter a month in advance of the change.
18. If a distributor’s check should bounce, there will be a service fee
of $25.00. The distributor will not be allowed to place future orders
using checks until the service fee is paid.
Product Return Policy
1.
Distributors are eligible for a 90 day, 100% money back guarantee on
the first order of products purchased from HHG, excluding shipping
charges. This does not include sales aids.
2. HHG shall
deduct from the reimbursement paid to the distributor any commissions,
bonuses or other incentives received by the distributor.
3. A distributor’s request of a 100% refund on their first order will
be taken as a request to cancel the distributorship. With the refund,
the distributorship will be canceled. If the distributor is unhappy
with these products, how could he/she be a successful distributor?
4. In order to receive a refund all of the following procedures must be followed:
A) The distributor wishing to return the product for a refund must call
Customer Service and receive a Distributor Return Authorization number.
DRA#.
B) All the products must be returned to HHG by the distributor who purchased it directly from HHG.
C) The return must have a letter with it telling the reason for the
return with the DRA# referencing it. The DRA# must be written on the
box being returned.
D) A copy of the original dated HHG Invoice (Purchase Order) must be
enclosed in the return box with all the container(s) or unused
portion(s) of the product in its original container.
E) Appropriate shipping carton(s) and packing materials are to be used in packing the products to be returned.
F) The shipping must be prepaid. HHG does not accept shipping-collect
packages. Only the cost the distributor paid for the product will be
refunded.
G) HHG recommends that returned product be shipped by certified or
insured mail. The risk of loss in shipping for returned product shall
be borne by the distributor. If returned product is not received by the
company’s Shipping Department, it is the responsibility of the
distributor to trace the shipment.
5. No refund of product will be made if the conditions of the procedures are not followed.
6. A distributor may return a damaged or defective product to HHG
within 30 days after the purchase for a replacement. The procedures of
#4 of this section must be followed for a replacement.
7. HHG Distributors must let their customers know that they may return
the product to them within the first 30 days for a 100% refund. At the
time of the return the distributor must give the customer a 100%
refund. As a distributor, you can send HHG the unused portion of the
product back to the company with a copy of your proof of purchase and
the customer’s proof of purchase. Procedures in #4 of this section must
be followed. HHG will send you replacement product(s) to make up the
full value.
8. The sponsors of distributors that have returned their first package
of product for a 100% refund, may have $150 deducted from a future
commission check, if they received a commission check the month the
refunded distributors placed their first order, and those distributors
were shown active on their distributor reports. For the fact of the
matter is that the refunded distributor being shown as active was not
really active, for he/she returned the product which canceled their
distributorship. They were shown as active on the reports only because
they had not returned the products before the reports were generated.
So commissions were paid out on products purchased by distributors who
returned the product for a 100% refund within the 90 day period.
9. Once reports are generated for a month the positions are set for the
month, even if some of those distributors return products credited for
the report month. There will be no future dispute about positions
because of a return.
Sponsor’s Responsibility
1.
It is the distributor’s responsibility to make sure that the people
he/she has sponsored are familiar with the products and the marketing
plan. The sponsoring distributor should make good use of the sales
tools, meetings and conference calls to this end.
2. The
distributor should encourage the people he/she has sponsored into the
business by frequent contact and by letting them know that they are
there to help them.
3. The distributor should be able to answer the basic product and
marketing plan questions from those they have sponsored. The new
distributor must feel confident enough to turn to their sponsor for
answers. If the distributor does not know the answer to questions,
he/she should find out as soon as possible.
4. Distributors should encourage the ones they sponsored to attend distributor trainings when they are made available.
5. Distributors who go inactive for 2 months or more will lose credit
for the people they sponsored.
6. Distributors should share their success with the distributors they
have sponsored, and other distributors in the sales organization.
Excitement is essential to the health of the sales organization of
which all the distributors belong and take benefit from.
